View Exclusive Use Provisions: How Much is Too Much? Exclusive use provisions (“EUP”), more often in retail settings than in office or industrial properties, can be an important negotiation point for your tenant clients in any setting. It’s a test of the tenant’s leverage in the lease negotiation. Smaller tenants may not be able to demand EUP protection, whereas larger tenants will be able to insist on this form of protection. There are both varying levels of leverage in a lease negotiation and degrees of every EUP as well.
